Description: NIAGARA FALLS WATER BOARD WATER TREATMENT PLANT – CHLORINE SCRUBBER REPLACEMENT ADVERTISEMENT FOR BIDS Sealed Bids for the construction of the Drinking Water Treatment Plant – Chlorine Gas Scrubber Replacement project in the City of Niagara Falls, NY will be received by the Niagara Falls Water Board (NFWB) at the Water Plant, 5815 Buffalo Avenue, Niagara Falls, NY 14304 until 3:00 P.M. local time on February 21, 2024, at which time the Bids received will be publicly opened and read aloud. Bids submitted by fax or email will not be accepted. The project consists of replacing the chlorine gas scrubber at the water treatment plant. Bids will be received for a single prime Contract. Bids shall be on a lump sum basis, as indicated in the Bid Form. The NFWB will complete the electrical work for the pumps and will supply the pump skid. The Niagara Falls Water Board insurance requirements are to be followed for this project. A pre-bid conference will be held for this project on February 13, 2024, 11:00 A.M. on-site at 5815 Buffalo Avenue, Niagara Falls, New York 14304. Only written Requests for Information (RFI) will be accepted. RFI’s will be accepted until 4:00 p.m. (Local Time) on February 15, 2024, at the office of the Engineer to the attention of Jay Meyers, P.E. via email: jmeyers@CPLteam.com . If necessary, an Addendum will be issued by 4:00 p.m. (Local Time) on February 19, 2024, from the office of the Engineer. Copies of the Contract Documents may be examined free of charge at the Niagara Falls Water Board or Office of the Engineer during posted business hours, starting February 5, 2024. If the documents are to be mailed, a check in the amount of $25.00, and made payable to CPL, shall also be provided. Alternatively, for shipment of Bidding Documents, Bidders can provide their UPS or FedEx shipping account number in lieu of the $25.00 check for mailing and handling. Each bid must be accompanied by a certified check or bid bond from a domestic carrier licensed to do business in the State of New York in the amount of not less than five (5%) of the amount of the bid submitted. Bidders on this work will be required to comply with the President's Executive Order Nos. 11246 and 11375, which prohibit discrimination in employment regarding race, creed, color, sex, or national origin. The successful bidder must be an equal opportunity employer, must meet all appropriate state and federal standards, and comply with all relevant governmental regulations. Statement of Non-Collusion : Bidders on the contract are required to execute a non-collusive bidding certificate pursuant to Section 103d of the General Municipal Law of the State of New York. Sales and Use of Tax Exemptions : The Niagara Falls Water Board is exempt from the payment of sales and compensation use taxes of the State of New York and of cities and counties, on all materials, equipment, and supplies sold to the Niagara Falls Water Board pursuant to this contract. Also exempt from such taxes are purchases by the Contractor and his Subcontractors of materials, equipment, and supplies to be sold to the Niagara Falls Water Board pursuant to this contract, including tangible personal property to be incorporated in any structure, building, or other real property forming part of the project. These taxes are not to be included in the Bid. This project is funded by New York State Environmental Facilities Corporation (NYS EFC). Prospective bidders should review the requirements included in the contract documents including American Iron & Steel Compliance (AIS). In addition, the Niagara Falls Water Board has established the following goals: 30% for MWBE participation, 10% for New York State certified MBE participation and 20% for New York State-certified WBE, and 6% for Service-Disabled Veteran Owned Businesses (SDVOB). All bids shall be binding for a period of forty five (45) days after the bid opening date. The Niagara Falls Water Board reserves the right to reject any and all bids and to waive any informalities therein. Date: February 5, 2024
