Description: NOTICE TO BIDDERS SEALED PROPOSALS will be received by the Village Clerk of the Village of Amityville at the office of the Village Clerk located at Village Hall, 21 Ireland Place, Amityville, New York 11701 until 2 pm (prevailing time) on Wednesday, November 1, 2023 at which time they will be publicly opened and read aloud and the contract awarded as soon thereafter as practical for: BID No. 23-03 Bicycle/Pedestrian Path Under LIRR Viaduct PIN 0762.04 Amityville, NY Instruction to bidders, plans and specifications, proposal sheets and form of contract may be seen or procured at the Village Hall, 21 Ireland Place, Amityville, NY 11701 beginning Thursday, October 5, 2023 from 9:00 am to 3:00 pm daily except Saturdays, Sundays and Holidays. There will be a non-refundable deposit of $50.00 in the form of a business check payable to the Village of Amityville for the bid package. The bid number must be clearly marked at the lower corner of the bid envelope. Each proposal must be accompanied by either a certified bank check on a solvent bank or trust company, or bid bond from a surety company acceptable to the Village in an amount equal to not less than five percent (5%) of the amount bid, made payable to the Village of Amityville as assurance that the Contract will be executed if awarded to such bidder. The Contractor will be required to complete the form of “Evidence of Successful Completion of Similar Projects” included in the proposal. The Contractor will be required to comply with the Labor Laws of the State of New York. Public liability and property damage insurance and construction bond will be required. The successful bidder will be required to enter into a contract for the performance of the work that may be awarded to said bidder for the total amount of the awarded contract price. Each Bidder must indicate how much of the contract will be completed by the Bidder themselves and how much by subcontractors. A bid may be rejected in the interest of the Village based on the extent of proposed delegation of the performance of the contract to subcontractors, or based on the level of qualification and experience of the proposed subcontractors. Each Bidder shall agree to hold its Bid price for forty-five (45) days after the formal Bid opening. In the event bids are rejected and/or no bids are received, the Village Administrator/Clerk is authorized to re-advertise for bids upon direction from the Board of Trustees. The Village encourages minority and women-owned businesses to participate. This is a Federal Aid Project and NYSDOT Standard Specifications, officially finalized and adopted on January 1, 2021 as posted on the New York State Department of Transportation’s website must be followed by the successful bidder. The DBE Goal for this Project is: 10% There are no M/WBE goals for this project. The EEO Employment goals for this project are: 5.8% Minority Employment Goal 6.9% Women Employment Goal The use of the NYSDOT approved civil rights reporting software, Equitable Business Opportunities (EBO) is required. Access authorization to EBO can be found at https://ebo.dot.ny.gov The Bidder to whom the Contract is awarded will be required to furnish Performance, Payment and Guarantee Bonds from an acceptable Surety Company for an amount not less than 100% of the accepted bid. The successful Bidder and all subcontractors must have an approved CCA-2 on file with NYSDOT prior to being awarded a contract. If the successful bidder does not currently have a CCA-2 on file with NYSDOT, the Bidder may find the CCA-2 forms and instructions online at: For-Profit Construction Questionnaire (CCA-2) | Office of the New York State Comptroller The successful Bidder will be required to comply with all provisions of the Federal Government Equal Employment Opportunity clauses issued by the Secretary of Labor on May 2, 1968 and published in the Federal Register (41 CFR Part 60-1, 33 F.2 7804). Successful bidders will be required to pay prevailing wages on this Contract. The New York State Department of Transportation, in accordance with wit Title VI of the Civil Rights Act of 1964, 78 Stat. 252, 42 U.S.C. 2000d to 200d-4 and Title 49 Code of Federal Regulations, Department of Transportation, Subtitle A, Office of the Secretary, Part 21, Nondiscrimination in Federally-assisted programs of the Department of Transportation and Title 23 Code of Federal Regulations, Part 200, Title VI Program and Related Statutes, as amended, issued pursuant to such Act, hereby notifies all who respond to the related solicitation, request for proposal or invitation to bid that it will affirmatively insure that in any contract entered into pursuant to this advertisement, disadvantaged business enterprises will be afforded full opportunity to submit bids in response to this invitation and will not be discriminated against on the grounds of race, color, national origin, sex, age, disability/handicap and income status in consideration for an award.
