Legal Services to Review and Update Contracts
Description:

The State University Construction Fund (“SUCF” or the “Fund”) is seeking proposals from law firms (herein referred to as the “Proposer(s)” or “Firm(s)” to provide professional legal consulting services (“Legal Consultant”) to the Fund for advice, guidance, and revision of the Fund’s existing contractual agreements for construction, design, commissioning, and construction management.

To be considered for award of the contract to provide these services to the Fund, a firm and key personnel of the firm must demonstrate:

  1. The firm has at least one office in the State of New York and must have legal authorization to do business in New York State by the New York Department of State.
  2. The firm has at least one attorney who will be providing counsel to the Fund who is licensed to practice law in the State of New York and will remain so licensed for the duration of this contract.
  3. The firm has one or more partners admitted to practice in the State of New York with a minimum of ten (10) years of relevant experience with actions or administrative proceedings on behalf of New York State and/or New York City governmental entities, arising from public construction projects, involving analysis of the New York State and/or New York City governmental entity’s construction contract, excluding personal injury matters and insurance defense, with preference to actions and proceedings involving the Fund and the Fund’s construction contract. Relevant experience may include engagements where the firm assisted with revisions of the New York State and/or New York City governmental entity’s construction contract.
  4. The firm must not have any conflict of interest in its provision of services to the Fund.

Pursuant to State Finance Law §139-j and §139-k, this RFP includes and imposes certain restrictions on communications between the Fund and potential offerors during the procurement process. Any questions regarding this RFP shall be directed to sucf.consultantprocurement@suny.edu

No firm which is considering submitting a proposal or which has submitted a proposal shall contact any Fund employee, other than the contact persons listed above during the period of the RFP about any matters related to the RFP or any proposals submitted in response to this RFP. Such contact may result in disqualification, termination, debarment and/or a determination of non-responsibility under applicable law (including without limitation State Finance Law Sections 139-j and 139-k, and applicable Fund policies, accessible on the Fund’s website https://sucf.suny.edu/opportunities/procurement-lobbying-act-policy-and-procedures).
