The County of McHenry in conjunction with McHenry County Lead and Healthy Homes Programs,
solicits qualified and interested contractors to submit proposals to perform Lead Abatement Contractor
work for low to moderate income homeowners throughout McHenry County.

Acceptance of Options
Options quoted will be reviewed and accepted or rejected at McHenry County’s discretion. Accepted
Options will be identified in the Owner-Contract Agreement or by Change Order if agreed upon by the
Contract after the Award of the Contract. Any of the options may be accepted by McHenry County and
may be used in determining the low submitter. The County reserves the right to accept or decline Options
to determine the low submitter. There may be multiple awardees.

Absolutely no Qualifications will be accepted after the time specified. Late Qualifications shall be

SPECIFICATIONS and SCOPE of WORK
The County of McHenry, Illinois, hereby solicits qualified and interested contractors to submit proposals
to perform Lead Abatement work for low to moderate income homeowners throughout McHenry County,
in accordance with federal, state, and local laws and regulations in conjunction with McHenry County
Lead and Healthy Homes Programs. The oversight for this program is directly from HUD. The projects
will be required to be compliant with local building codes and if applicable where permits may be
required. The projects are to be compliant with OSHA, FEMA, EPA, IDPH and HUD.
Submissions should include all items addressed in the evaluation of proposals as specified, and include
the following:
General company information and background, name of primary contact person and contact
phone number and email address.
Any or all professional licenses applicable (but not limited to) the services listed. Local
municipalities within McHenry County may need to have licenses per the scope of work and the
local building department regulations.
Pricing Schedule or Rate Sheet of Hourly rates. Please refer to Fee Schedule (in Excel format).
Specific services may be broken down separately. We defer to your company’s discretion for
additional rates and services to be included.

Prospective contractors also should be aware that while McHenry County is to provide funds for payment
of projects, job contracts shall be between the homeowner and contractor and payment will be received
upon clientele and County’s approval of project completion.
Lead Abatement Contractor work includes, but is not limited to:
Must be licensed.
Must have a proven track record of quality performance on Lead Abatement or Renovation
projects. References are required on a minimum of three (3) projects.
Must consistently do good quality work according to IDPH, EPA, Lead license Specifications.
All work shall be done according to the local code. The contractor is responsible for obtaining all
necessary permits when required according to the contract.
Must remain current with all new Federal and State Guidelines concerning Lead Based Paint
Abatement - especially concerning Certification and Training of Employees.
Must warranty all work for a period of one (1) year from the date of the final inspection, unless
otherwise required by law. During this one (1) year warranty period, the contractor must be
willing to investigate the homeowner's complaints regarding items that were completed during
the project. Any responses to complaints must be made in a timely manner.
Must submit LEAD TRAINING CERTIFICATES and LEAD LICENSES, for all project
managers, supervisors, foremen and workers. They ALL must be EPA trained, certified, and
licensed by and according to EPA 40 CFR 745. Must undergo certification and licensing by
IDPH (EPA).

Law 31 testing must be performed by an IDPH (EPA)-certified inspector or risk assessor
independent of the owner or any lead paint abatement firm.
Confirmation of protocol - OSHA requires that hand washing facilities be provided where
occupational exposure to lead occurs. In addition, change areas, showers (where feasible) and
lunchrooms or eating/rest areas are to be made available to workers exposed to lead above the
(permissible exposure limit) PEL.
Skilled, Trained, Licensed contractor business - Provide Lead hazard abatement and remediation
services for McHenry County’s HUD Healthy Homes grant.
Contractor must have regulatory equipment which includes but not limited to safety protective
clothing, goggles, dust barriers, surface protection, negative air machines, HEPA vacuums, Lead
disposal bags, Lead dust wipes, cleaning products and a breathing apparatus to safely remove
Lead from a home. All equipment must meet or exceed EPA-RRP requirements.
Contractors must be experienced and manage to safely remove Lead from a home and then
dispose of it properly/ethically by Federal & state standards.
Contractors must obtain government issued permits as required for disposal.
All members of a contracting team must follow government issued protocols including the
completion and submission of a medical release form for each worker on all projects requiring
Lead dust removal as per guidelines.
Comply with Federal and state lead abatement standards to stabilize a home and meet clearance.
Must be knowledgeable and be compliant in Lead abatement per 410 ILCS45/ Lead Poisoning
Prevention Act.
Must comply with OSHA permissible exposure limits(PEL) during an eight-hour time averaged
working day. 50 ug/m3.
All mitigation and abatement activities shall be done in a way that will not endanger the
occupants, including work area isolation, preparation and containment, safe work practices, and
safe removal of all potentially harmful materials (410 ILCS 45/11) (77 Ill. Adm. Code
845.265(a))
To ensure the health and safety of occupants and workers, a Work Practice and Occupant
Protection Plan shall be produced by a licensed lead supervisor and followed for each project.
The plan shall include, among other things, the requirements for pre-cleaning, specification of the
barriers and containment systems, and description of the lead safe work practices to be used. (77
Ill. Adm. Code 845.255(a)) b. The lead abatement contractor shall display caution signs outside
all entrances and exits to each work area before beginning work and keep the signs posted until
the abatement or mitigation is completed and final dust clearance results have been obtained. (77
Ill. Adm. Code 845.255(b)) c. Unauthorized persons are not permitted to enter the work area. The
contractor shall ensure that occupants and pets use alternative entrances and exits. (77 Ill. Adm.
Code 845.265(d)(2)) d. The following work practices are prohibited for any lead abatement or
mitigation activities: open flame burning, dry sanding, open abrasive blasting, uncontained hydro-
blasting, methylene chloride, and dry scraping.
If Soil is found contaminated IDPH Guidelines for Abatement and Mitigation of Lead-
Contaminated Soil a) Soil abatement, including removal of lead-contaminated soil, shall be
conducted in accordance with methodologies outlined in Section 845.15 and meet the following
requirements; 1) All soil removal work shall be conducted by licensed lead abatement contractors

employing licensed lead workers who are supervised by a licensed lead supervisor; 2) Worker
protection shall be provided as required in Section 845.260. At a minimum, all workers removing
leaded soil shall be provided with a changing area equipped with a facility for washing or
showering. Workers shall be required to change into personal protective clothing before entering
the work area, and to remove personal protective clothing and shower or wash before leaving the
work area; 3) A Work Practice and Occupant Protection Program as required by Section 845.255
shall be developed; 4) Equipment decontamination procedures shall be employed to prevent the
spread of lead contamination. Disposable items are not to be reused and shall be discarded as
provided in Section 845.285. The equipment decontamination procedures shall be outlined in the
Work Practices and Occupant Protection Program required by Section 845.255; 5) Prior to
beginning soil removal, the source of the lead contamination of the soil shall be identified and
eliminated if possible, to prevent re-contamination of the abated area; 6) Removal of the lead-
contaminated soil shall be accompanied by dust suppression methods to keep the generation of
dust to a minimum; de 845.270)
Selection:
Based on the evaluations, and potential interviews or presentations, the County shall select no fewer than
three Professionals which it determines to be the most qualified to provide services regarding the specific
project. A scoring process will be performed by the Grant Manager as well as an additional 3 members of
the Community Development Staff to determine applicant preferences levels. The County shall then
contact the professionally ranked most preferred and attempt to negotiate a contract at a fair and
reasonable compensation, considering the estimated value, scope, complexity, and professional nature of
the services to be rendered.
HUD guidelines encourage Women Business Enterprises (WBE), Minority Business Enterprises (MBE)
& Section 3 businesses to apply.
Submittals, if fewer than three Professionals submit Qualifications and the County determines that one or
both of those Professionals are so qualified, the County may proceed to negotiate a contract as set forth
herein.
Selection shall be made of the Professional deemed to be fully qualified and best suited among those
submitting Qualifications, based on the factors involved. It is the intent of the County of McHenry to
select the Professional whose Qualifications meet or exceed the requirements as outlined. Information
and/or factors gathered during interviews, presentations, negotiations, and any reference checks, in
addition to the evaluation criteria stated, and other information or factors deemed relevant by the County,
shall be used in the final selection decision.
The County expects to make multiple awards.
