Mandatory Pre-Bid and Site Walk

MANDATORY: A mandatory pre-bid meeting and site walk will be held on Thursday, March 21, 2024 at 3:00 PM at
Wright Elementary School, 4060 Lone Oak Rd. SE, Salem, OR 97302. Meet at the main entrance. This is a good time
for Bidders who may have questions and any suggestions they wish to make. The meeting is mandatory and is held
for the benefit of the Bidders. All Bidders wishing to submit an Offer must attend. Sign-in will begin 15 minutes prior to
start of meeting. Bidders must be signed in by no later than 10 minutes after meeting start time. Any Proposers not
signing in by that time will be deemed late and not eligible to submit an Offer. The District reserves the right to
consider unusual or extenuating circumstances.
Please note this is an in person meeting. Take your travel time into account so your not late.

5 Acknowledgment
In submitting this bid, it is understood that the right is reserved by Owner to reject any or all bids and waive all
informalities in connection therewith. It is agreed that this bid may not be withdrawn for a period of sixty (60) days
from time of opening. The undersigned hereby acknowledges that they have read and understand the Drawings,
Specifications, Addenda, and all other Contract Documents pertaining to this Project. The undersigned certifies that
the Contract Documents are, in their opinion, adequate, feasible and complete for performing the Work and
constructing the Work in a sound and suitable manner for the use specified and intended by the Contract
Documents. The undersigned further certifies that they have, or has available, the equipment, personnel, materials,
facilities and technical and financial ability necessary to complete the Work in accordance with the Contract
Documents and within the time specified therein. The Bidder certifies that they have made allowances for normal
inclement weather indigenous to the Project site.

7 Equity in Public Contracting

For any project that requires DEQ 1200-C inspections, the General Contractor is responsible for providing a certified Erosion
and Sediment Control Inspector for all 1200-C inspections, inspection logs, and maintenance in accordance with DEQ 1200-C
Permit requirements. All documents required by DEQ to facilitate a permit transfer to the General Contractor’s Erosion and
Sediment Control Inspector must be submitted and approved by DEQ prior to construction start.

3 By submitting an offer, the successful bidder agrees that when any changes in Work are ordered which involve

1 Schedule
4 Notice to Proceed: Notice will be issued for work to begin on or about , JUNE 17, 2024 or as otherwise negotiated
with District. Substantial Completion: JULY 26, 2024. Final Completion: AUGUST 30, 2024. The undersigned agrees
to complete all Work under this Contract within the dates specified in the milestone or specific date schedule, as set
forth in the Owner Contractor Agreement and the Supplementary Conditions Section, if included.

1 Liquidated Damages
5 Liquidated Damages: Owner and Contractor recognize that time is of the essence for this Agreement and that
Owner will suffer financial loss if the Work is not completed within the times specified in the schedule, plus any
extensions allowed by Owner. Owner and Contractor also recognize the delays, expense, and difficulties involved in
proving the actual loss suffered by Owner if the Work is not completed on time. Accordingly, instead of requiring any
such proof, Owner and Contractor agree that as liquidated damages for delay (but not as penalty) Contractor shall
pay Owner FIVE HUNDRED DOLLARS ($500.00) for each day that expires after the time specified in the schedule,
until the Work is complete.
