BEEN DESIGNATED AS A SHELTERED MARKET PROCUREMENT
OPPORTUNITY, WHICH WILL ONLY BE OPEN FOR COMPETITION BY
AND BETWEEN SBE COMPANIES. ONLY VENDORS CERTIFIED AND
APPROVED BY THE CITY OF MEMPHIS AS A SMALL BUSINESS
ENTERPRISE MAY BID ON THIS PROJECT. COPIES OF THE ORDINANCE

Summary of Request
The City of Memphis, through the Division of Memphis Parks, is seeking qualified
contractors to provide food vendors (Mobile Food Truck) services for the purpose of
providing value-based menu items as needed by the City, to include having the capacity
to host small, medium, and/or large scale events at a variety of spaces and venues that are
spread out over the City of Memphis, based on scheduled events. The chosen vendors
must be able to offer a full-service mobile food truck operation for a range of attendees,
which may range from as few as 100 people up to 3,500; must comply with the
Tennessee Department of Health's regulations for mobile food establishments; and must
have a food permit to operate. At the present time, the City of Memphis desires to solicit
contractors who can provide the above service.
The intention of this solicitation is to provide City of Memphis with an expedited means
of procuring supplies and/or services as well as maintenance for various divisions at the
lowest possible cost. This contract is for the convenience of the City of Memphis and is a
“Non-Exclusive” use of this contract. The City of Memphis does not guarantee any
usage.
The City intends to select an unspecified number of contractors and enter into two-year
(2) contractual agreement upon date of execution (date contract signed by the Mayor)
with two (2) additional one (1) year period(s) based upon performance, need and/or
funding availability to be agreed upon by both parties.
The City of Memphis reserves the right to (a) accept or reject any and/or all submissions
of proposals; (b) to waive irregularities, informalities, and technicalities; and (c) to accept
any alternative submission of proposals presented which, in its opinion, would best serve
the interests of the City. The City shall be the sole judge of the proposals, and the
resulting negotiated agreement that is in its best interest, and its decision shall be final.
The City also reserves the right to make such investigation as it deems necessary to
determine the ability of any submitting entity to perform the work or service requested.
Information the City deems necessary to make this determination shall be provided by the
submitting entity. Such information may include, but is not limited to, current financial
statements by an independent CPA, verification of availability of equipment and
personnel, and past performance records.
If any addenda are issued to this Request for Proposals, the Purchasing Division will post
them to the City's website at https://www.memphistn.gov/business/rfps-rfqs/. Submitting
organizations are strongly encouraged to view this website often to see if addenda are
posted. Failure of any proposer to receive such addendum or interpretation shall not
relieve such Proposer from any obligation under his proposal as submitted. All addenda
so issued shall become part of the Contract Documents.
Mandatory Pre-Qualification Conference
There is no pre-bid meeting scheduled for this RFQ.
1. Specifications for Mobile Food Truck
a. The contractor is responsible for providing staff, all supervision, labor,
equipment, food items, beverages, materials, supplies, generators, and other
necessities.
b. The contractor will be expected to promote the programs/events via methods
approved and provided by the City.
c. The contractor must demonstrate knowledge and expertise in the proper
operations of food/beverage mobile food services and be equipped to
accommodate up to 3,500 guests as determined by the City, as described per this
RFQ.
d. The contractor must be able to provide services to the Play Your Park and
Community Engagement departments for a variety of events throughout the year.
The City is expected to host approximately 1020 events for the City's
community and senior centers. Although there will be other Mobile Food Trucks
operating each vendor will be required to be able provide food for approximately
three (3) to four (4) hours.
e. The contractor must be capable of providing reasonable cost food menu items
and provide services in a timely manner.
f. The contractor will follow all guidelines from the Shelby County
Environmental Food and Safety Program that are required when operating a
Mobile Food Truck.
g. The contractor must have a valid business license from Shelby County to
operate and perform the duties listed in this contract. Vendor must have
experience in preparing local food experience, and verifiable client references.
Please note: Permits for your brick-and-mortar establishments will not be
accepted for your Mobile Food Truck, you will need a permit specifically for your
food truck.
h. The contractor must display an up-to-date Food Inspection permit prominently
on the window of his/her Mobile Food Truck for all (customers) to see.
Contractor will also ensure he/she update the permit before or at least by June 30,
2024 in order to prevent disruption in service. Note: Contractors shall maintain
annual permits for the term(s) of this agreement. Tennessee permits are renewed
July 1 thru June 30th of each year.
i. The contractor must ensure he has access to hot and cold running water, and it is
installed on the truck. The vendor must have a three-compartment sink installed
on the Mobile Food Truck and ensure all cooking utensils and serving
utensils are always clean and sanitized.
j. The contractor must ensure a separate working handwashing sink (station)
and hand soap is installed on the Mobile Food Truck and that employees are
utilizing it to wash their hands when necessary. The contractor will not place any
food items outside of the Mobile Food Truck except condiments and drinks.
k. The contractor will ensure he/she follow the temperature guidelines that have
been designated by the State and Shelby County; meaning hot foods in warmers
are always kept at a temperature of 135 degrees Fahrenheit or above while
operating (selling /cooking food) the Mobile Food Truck.
l. The contractor will ensure cold foods are always kept at a temperature of 41
degrees Fahrenheit or below while operating (selling food) the Mobile Food
Truck.
m. All goods and services shall be prepared and provided in a safe manner in
accordance with federal, state, local laws, and the Tennessee Department of
Health’s regulations for mobile food establishments. The vendor will always
operate according to the beforementioned guidelines.
n. Contractors using Smokers to prepare food must have the Smoker attached
to the back of his/her Mobile Food Truck and screened in.
2. MONITORING AND AUDITS
a. The City will engage in monitoring the services provided by the contractor to
document progression and other inspections to verify proper guidelines and
methods are being used when preparing food during the duration of the
contract. The contractor’s failure to cooperate fully with the designated
monitor may result in termination of the contract.
b. The City reserves the right to inspect the food truck at any reasonable
time during the terms of this agreement.
3. INVENTORY AND ACCESS TO COMMISSARY
a. Mobile food units shall operate from a commissary or other fixed service
establishment and shall use this facility for all supplies.
b. The contractor shall maintain, at all operating times, adequate inventory of all
menu items required for the scheduled event to serve at each location.
4. SAFETY AND DRUG AND ALCOHOL-FREE WORKPLACE
a. Contractor will ensure his/her Mobile Food Truck is equipped with at least
one Class K-Fire Extinguisher; this is in addition to the regular ABC fire
extinguisher needed to combat other fire hazards unrelated to cooking.
b. Contractor is responsible for ensuring they have an operating exhaust fan if
they prepare food that produce grease vapors.
c. The contractor will ensure cooking equipment is protected by an automatic
fire extinguisher system.
