The following information becomes part and parcel of Invitation for Bid (IFB) #424-89-4-17 effective
this date. Firms must acknowledge receipt of this addendum in their solicitation response.
The listed items add to, modify, or otherwise alter the specifications and become part of the solicitation
documents. Where a portion of the original specifications are added to, modified, or also altered, the
portion not so affected shall remain. Firms may have the right to protest this addendum.
Inquiries/ District Responses
Before the solicitation inquiry deadline of April 4, 2024, the District received inquiries regarding this
solicitation. The District’s response to each question follows in bold font.
1) Please confirm that GC License less than BD4 with be allowed provided the bidder must remain
within their own bidding limits as allowed per SC State Law.
This is correct, the GC License must match the price threshold of the awarded work. The GC
Class 4 License is only required if the awarded jobs price reaches those GC thresholds.
2) During the Pre-Bid, it was stated that Performance & Payment Bonds would NOT be required.
However 5% Bid Bond is required. Please confirm.
Confirmed. 5% bid bond is required per bid documents.
3) Is the contractor responsible for security during normal business hours?
Contractor is not responsible for security during summer hours (Mon-Thur 7:30am-5:30pm).
Contractor is responsible for security when working during non-Summer hours.
4) Please confirm that each school listed on the bid form can be award to different contractors after
determined to be the Lowest Responsible Bidder.
Confirmed. Award(s) will be by location.

5) If a contractor is low bidder on multiple schools, will there be 1 inclusive contract or will each school
have its own separate contract and scope of work included?
Each school awarded will be a separate purchase order, even if multiple schools are awarded to
one contractor.
6) The definition for core in the schools for painting?
Definition is school specific. See scopes of work. But generally, Core is common spaces (corridors,
group toilets, cafeteria, gymnasium, auditorium, media center, doors/frames, exterior,
etc…Anything that is not a classroom or office/workroom). Note that some scopes include certain
classrooms & offices as part of core. This is described on the specific scopes of work.
7) TR High School is Core only, a revised scope will be sent out.
Please see attachments is separate document listed as Addendum 1A Painting revisions
8) Page 11, #5 on the IFB will be eliminated (discussed wood door refinishing).
Correct, please remove #5 on page 11 of the Solicitation.
9) Bidders are required to have a General Contractors License Class 4 or higher to be eligible for bid
per the requirements listed in the IFB document and previous district decisions/precedent? Please
confirm.
The GC License class only has to match the price threshold of the work to be awarded. GC Level 4
is no longer required for award. This is to be removed from the bid narrative.
10) This was not discussed but we would like to clarify in the addendum. The prime GC and their listed
subcontractor(s) must both/all have an active General Contractors License in the state of South Carolina
and hold a Class 4 minimum to be eligible for award? The prime contractor holding a license only, and
not their listed subcontractor, will disqualify them from award? Please confirm.
The GC License class only has to match the price threshold of the work to be awarded. GC Level 4
is no longer required for award. If subcontractors are identified in the bid response, then the
prime contractor must list the expected price of work that the sub will perform and the GC
License class of the subcontractor must be able to meet the pricing threshold of work to be paid
for. Both the prime and subcontractor should have a GC license that matches the price threshold
of work to be awarded for the prime contractor and/or work to be distributed to the
subcontractor.
11) The following were asked in the meeting:
a. To confirm, this meeting was mandatory and only the bidders (if eligible) attending this
meeting today 03/28/2024 @ 2:00 pm will be eligible to bid on the Summer Repaints
2024 IFB?

Attendance is required at the pre-bid meeting to be eligible for award.
a. If a bidder chooses to use a subcontractor or in other words a 1099 entity, the
subcontractor(s) must also follow the SC Code of Laws and all Federal Laws and
Regulations?
All responsive bidders and identified subcontractors must follow SC Code of Laws
and Federal Laws and Regulations where applicable to be eligible for award.
b. If a bidder chooses to use a subcontractor or in other words a 1099 entity, that
subcontractor, if requested by the District, must be able to show W-2 records for their
employees, not 1099s, as required by State and Federal Law?
The District has the right to request records of all employees to be used on the job
site for an awarded contractor.
c. If a bidder chooses to use a subcontractor or in other words a 1099 entity, that
subcontractor, if requested by the District, must provide records of E-Verify for all
employees?
The District has the right to request additional records and information from a
responsive bidder.
d. Payment to “employees” via 1099 at either the prime or subcontractor level will not be
acceptable under State and Federal Law?
A 1099 subcontractor is not considered a W2 employee for a responsive bidder.
e. If requested by the District, a prime contractor and their subcontractor must produce the
following for award eligibility verification:
i. Federal 941 Reporting
ii. Workers Compensation Rating Worksheets
iii. SC Quarterly Unemployment Reporting
iv. South Carolina Income Tax Returns
v. Federal Income Tax Returns
The District may request additional information from responsive bidders as needed.
