The purpose of this solicitation is to bind a competent, experienced real estate and marketing professional into a formal Agreement with the COUNTY to perform the work described in this Request for Proposals and the attachments hereto.

Proposers are cautioned to read the entire Request for Proposals, noting all particular submittal requirements, including both substance and format. Failure to provide all requested information in the manner required might be cause for rejection of proposal at the sole discretion of the COUNTY.

for
REAL ESTATE SALES AND MARKETING SERVICES FOR AN AFFORDABLE WORKFORECE
HOUSING PROJECT (NELLIES NEIGHBORHOOD).

Overview
Summit County Government is the owner of the subject property, a 2.08-acre parcel located along Miners Creek
Road within the Bills Ranch Neighborhood adjacent to the Town of Frisco, to be developed as Nellie’s
Neighborhood (the “Project”). As the property owner, Summit County has rezoned the property to a PUD from R-
2 (Residential, 2 units per acre) to Planned Unit Development to accommodate the development of 15 new local
workforce housing units for the Summit County workforce. The County currently has a Site Plan application
submitted for the site for 15 units that is expected to be approved at a future March 14, 2024, Ten Mile Basin
Planning Commission meeting.
Working with Summit Homes as the general contractor “Builder”, the proposal is to develop the property with a
total of 14 new detached single family dwelling units with garages and one existing cabin, using the accessory
dwelling unit (ADU) stock plan designs, prepared by Design Path Studios, which are attached as Exhibit A. The
existing cabin on the site will be remodeled and sold as part of this development. The ADU stock plan concepts
are a mix of roughly 550 sq. ft. one-bedroom and 950 sq. ft. two-bedroom homes. These units are proposed to be
“For Sale” primary dwelling units that will provide smaller, more affordable homeownership opportunities for the
local workforce, with a building character and scale that blends into the surrounding neighborhood. In addition, the
units will serve as “proof of concept” for property owners throughout Summit County who are potentially interested
in using the ADU stock plans to build an ADU on their property. This will allow property owners in the County to
see what the ADUs from the stock plans will look like when built. Each of Design Path Studio’s four ADU stock
plan designs are represented within the proposed development, and include:

OVERALL DEVELOPMENT GOALS AND PRICING
The Project is proposed to establish a residential community that blends into the surrounding Bills Ranch and
Town of Frisco neighborhoods and consists entirely of for-sale affordable workforce housing units.
All 15 units will be deed restricted and sold at a range of prices between 85% AMI and 110% AMI.

This invitation should not be construed as a commitment of any kind on the part of the COUNTY, nor does it
commit the COUNTY to pay for any costs incurred in the submission of a proposal package, nor for any costs
incurred prior to the execution of a formal Agreement.
Expectations of the “SALES MANAGER”
The general criteria and expectations of the SALES MANAGER are as follows:
The County will rely on a committed and passionate SALES MANAGER with experience in real estate
marketing and promotion.
The SALES MANAGER will be able to work independently with minimal guidance from the County.
The SALES MANAGER is an advocate for the County and works on the County's behalf making sure that
the County's best interests are at the center of any decisions.
When problems on the project arise, the SALES MANAGER will study the problem, develop solutions,
evaluate the impacts of the solutions on quality, schedule, and budget, and make a clearly defined
recommendation to the County with supporting information.
The SALES MANAGER should understand the project budget, including the construction costs and
projected revenue.
The SALES MANAGER should recognize that the County is subsidizing the project (sale proceeds will not

cover construction cost) and therefore the proposed fee for the real estate and sale/marketing services will
be a very important consideration in evaluating the proposals.
The SALES MANAGER and the County will develop a framework on when to report to the County so that
there are no unexpected changes to budget.
The SALES MANAGER must be able to work effectively as part of the project team that includes the
County, Summit Combined Housing Authority, architect, and Builder.
The SALES MANAGER should understand Fair Housing issues related to the marketing and sale of
residential real estate.
The SALES MANAGER should be familiar with the local real estate and the local housing needs within
Summit County and be able to promote the project to (and work effectively with) the local workforce
buyers that the project is targeted to.
The SALES MANAGER will maintain records of the marketing efforts and project sales including available
units, wait lists, sales contracts, closings, etc.
The SALES MANAGER will be able to obtain insurance coverage for professional liability, general
liability, worker's compensation (if required by the State of Colorado) and automotive liability.
Work shall be completed as set forth in a contract for this project to be negotiated with the County \ based
upon the contractor’s written proposal.
Phase I - Pre-Sales/Project Launch:
The SALES MANAGER will prepare a marketing plan and a final budget for the marketing and sale of
the units, and establish sales goals and procedures for pre-sales, reservations, contracts, earnest money,
walk thru, and closings, etc.
The SALES MANAGER will assist in branding the PROJECT (Nellies Neighborhood) and coordinate
with the design team the production of marketing materials, flyers, graphics, floorplans, and material
boards. The SALES MANAGER will create a website and utilize social media for use in promoting the
project and will ensure the Homes are listed in the MLS, and on a project web site as well as other sales
platforms.
The SALES MANAGER will work closely with the Summit Combined Housing Authority to establish a
process for their services including pre-qualifications, buyer qualifications, etc.
The SALES MANAGER will work closely with appraisers, lenders, title company and other
stakeholders to ensure appropriate mortgage options are available for potential buyers.
The SALES MANAGER will create a plan for realtor participation, that shall be approved by the County.
The SALES MANAGER will conduct a project launch event and accept reservations and pre-sale
contracts.
The SALES MANAGER will work closely with the County and the Builder to coordinate the sales
activities with construction activities and with the Builders customer service activities that include punch
list and warranty related items. This will include attending weekly project team meetings.
The SALES MANAGER may be asked to assist the County in finalizing community documents
including the HOA documents and the Deed Restriction (Restrictive Housing Covenant).
Phase II - Construction/Sales:
The SALES MANAGER may be asked for input relative to the project plans and specifications as to
their appropriateness for the project, based on their experience with similar projects and understanding of
the market.
The SALES MANAGER will offer excellent customer services and assist the buyers through the
process. This will likely involve assisting buyers and the Builder (Summit Homes Construction) with the

coordination of finish choices.
The SALES MANAGER will manage sales contracts, working closely with buyers, lenders, appraisers,
title companies, etc. to ensure all documents, approvals, qualifications, etc. are available for closings.
The SALES MANAGER will provide regular updates to the County regarding the market/sales plan and
schedule.
Phase Ill - Project Completion/Closings:
The SALES MANAGER will report to the County and will manage the sales, including the closings and
move-ins.
Other tasks as required.
Date and time of service
Service will be performed on an ongoing basis beginning the Spring of 2024 until all units are sold and closings are
completed.
Service will be performed on a regular schedule to be agreed upon prior to the contract. The potential schedule should
be included in the realtor’s written proposal.
Indemnification and Insurance
The Sales Manager shall indemnify and hold harmless the County from and against all claims, damages, losses, and
expenses arising out of or resulting from acts or omissions of the Contractor, Contractor’s sub-contractors or
otherwise arising out of the performance of services by Contractor. No later than seven (7) days following the
execution of an Independent Contractor Agreement between the County and Contractor, the Contractor shall
provide the County with certificates of insurance evidencing the types and amounts of insurance specified below:
Standard Workers’ Compensation as required by law in the State of Colorado; and
Comprehensive General Liability Insurance for operations and contractual liability adequate to cover the
liability assumed hereunder with limits of not less than $400,000 on account of any one person and $1.2
Million for each occurrence of property damage and personal injury; and
Automobile Liability insurance in those instances where the Contractor uses an automobile, regardless of
ownership, for the performance of the Services. Contractor shall carry insurance, written on the
comprehensive automobile form insuring all owned and non-owned automobiles with limits of not less than
$400,000 (bodily injury per person), $400,000 (each accident) and $400,000 (property damage).
Insurance coverage shall not be reduced below the limits described above or cancelled without the County’s written
approval of such reduction or cancellation. Certificates of such insurance, of agents and subcontractors, shall be
provided to the County upon request. Regarding all insurance, such insurance shall:
Be primary insurance to the full limits of liability herein before stated and, should County have other valid
insurance, County insurance shall be excess insurance only; and
Not cancelled without thirty (30) days prior written notice to the County.
Proposal Format
Costs for performing services outlined in this request for proposals shall be clearly stated to allow the County to
effectively evaluate each proposal.
Refinements and Improvements

Applicants should feel free during the proposal submission process to provide any suggestions or comments that
might be advantageous for the County to consider in terms of any efficiencies, issues, or processes. The County is
not committed to any single scenario, but efficiency of resources and minimizing impacts are critical in completing
this work.

Part I - ADMINISTRATIVE INFORMATION

This Request for Proposals (“RFP”) is issued by the County Housing Department. For questions, please contact

B. Purpose
This RFP provides prospective realtors with sufficient information to prepare and submit proposals for
consideration by the County. To be considered responsive, each proposal must provide for completion of the tasks
outlined in the RFP.
C. Scope
This RFP contains the instructions governing the proposals to be submitted and the materials to be included therein.
These are mandatory requirements that must be met to be eligible for consideration.
D. Scheduling
Proposals must be submitted via email to Don.Bantam@SummitCountyCO.gov to the County Housing Department
by April 22nd, 2024, no later than 4:00pm MST/MDT. The proposal should outline the schedule for
commencement of service.
E. Inquiries and Questions
Prospective applicants are welcome to make inquiries and ask questions concerning the RFP to obtain clarification
of the any requirements or schedule a site visit to the property. The last day for questions will be April 18th at
