A bid bond in the amount of 5% of the total amount bid shall be attached to all bids as a guarantee that the successful bidder will, within ten (10) days of the date of notice of award, enter into contract and file the required bonds. No bidder may withdraw his bid within 45 days after the actual date of the opening thereof.

The Owner reserves the right to reject any or all bids, waive any irregularities or technicalities without assigning any reason therefore, and to make the awards in the best interest of the Owner.

Federal funds are being utilized for this project. Project is Land and Water Conservation Fund (LWCF) Project No. 40-01248

All bids must comply with US Department of Labor, 29 CFR 5; Subpart A - Davis-Bacon Act for the use of the appropriate Davis-Bacon prevailing wage rate(s) for the county and state in which the project is located; and Subpart B, Fringe Benefit Provisions.

All bids must include assurances that the following provisions will be complied with: Federal Labor Standards Provisions U. S. Department of Labor 29 CFR Part 5; Section 3 of the Housing and Urban Development Act of 1968, as amended, 12 U.S.C. 170IU which requires that to the greatest extent feasible opportunities for training and employment be given lower income residents of The City of Guthrie and contracts for work in connection with the project be awarded to business concerns which are located or owned in substantial part by persons residing in the area of the project; Section 109 of the Housing and Community development Act of 1974 which assures that no person shall on the grounds of race, color, national origin or sex be excluded from participation in, be denied the benefits of, or be subjected to discrimination;

Certification of Non-segregated Facilities which assures that bidder does not maintain or provide any segregated facilities; Equal Opportunity Provision, EO 11246, as amended, which assures non-discrimination; Minority Business Enterprise and Women Business Enterprise Provisions which encourage minority owned businesses and women owned businesses to bid on the project; assurances that surety companies executing bonds appear on the Treasury Department’s list and are authorized to transact business in the State of Oklahoma. Contracts for this construction will require the submissions of a preliminary statement of anticipated work force and subcontractor needs for project construction work, as well as the submission of written goals (number of employees and dollar amount to subcontractors) for utilization of lower-income residents and small disadvantaged businesses located within the City of Guthrie.

The proposed contract is subject to the Government Debarment and Suspension (DOT Regulation 49 CFR Part 29), Subpart F – Drug-Free Workplace Requirement (Grants).

This project is subject to American Iron and Steel provisions. As required by Section 70914 of the Bipartisan Infrastructure Law, none of the funds under a federal award that are part of Federal financial assistance program for infrastructure may be obligated for a project unless all of the iron, steel, manufactured products, and construction materials used in the project are produced in the United States, unless subject to an approved waiver. The requirements of this section must be included in all subawards, including all contracts and purchase orders for work or products under this program.

In accordance with the Build America, Buy America (BABA) Act requirements of the Federal Regulations (23 USC § 313 and 23 CFR § 635.410) all manufacturing processes, including the application of coating, for all steel and iron products furnished for permanent incorporation into the work on this project shall occur in the United States. The BABA Act requirement does not supersede the AIS requirement, and both provisions still apply and work in conjunction.

System for Award Management (SAM) registration and a UEI number is required for Bidders (Prime contractors) in order to award projects. UEI number shall be required prior to submitting bids.

Specifications are on file in the office of Myers Engineering, Consulting Engineers, Inc., at 13911 Quail Pointe Drive, Oklahoma City, OK 73134 Phone (405) 755-5325, and are available electronically for a non-refundable payment of $50.00. Contractor will be issued a username and password to retrieve the Specifications upon payment. Contractor must obtain plans and specifications from the office of the Engineer and be registered on the Engineer’s bid list to be recognized as an eligible bidder for this project.

Offerors are responsible for submitting proposals, and any modifications or revisions, so as to reach the office designated in the solicitation by the time specified in herein.

Any proposal, modification, or revision received at the office designated in the solicitation after the exact time specified for receipt of offers is “late” and will not be considered.
