2. QUESTIONS & ANSWERS RECEIVED AT THE PRE-BID
CONFERENCE AND VIA EMAIL.
Q1: Can we use a non nuclear gauge for the asphalt testing? The RFQ calls for
utilizing a nuclear density gauge but we have a non nuke Instro Tek gauge for
asphalt.
A1: Yes. Contractors can use other means of conducting the testing of materials so
long as they provide accurate and consistent results and are standard methods in
the industry for which they are utilized.
---------------------------------------------------------------------------------------------------
Q2: Will the City of Pawtucket consider modifying section 6.0 of the RFQ? As presently
written, the provision is an overly broad waiver of claims and indemnification
provision that relates merely to the consultant’s presence on the City’s property
without any nexus to the consultant’s negligence. Will the City consider the
following changes to Section 6.0?
A2: In cases of exception to any RFQ language, the City normally instruct the bidders
that they are encouraged to simply note any exceptions within their bid
submissions for approval. In this case, the City is inclined to approve, as the
language in question relates mainly to general construction work and not to the
type of consulting work referenced in the RFQ’s Scope of Work.
