LIVING SHORELINE DEMONSTRATION PROJECT
1. GENERAL
The city of Folly Beach seeks qualifications for consulting services for design, permitting, and oversight of
installation of a Living Shoreline Demonstration Project on the banks of the Folly River Park. See
Attachment A.
The city of Folly Beach is a municipality in Charleston County with 2,078 full-time residents. Folly River
Park is a 4+ acre park with ~100 linear feet of shoreline between the Lee Westbury Bridge and the fishing
dock at the park.
In 2021, OCRM created regulations to permit living shorelines on private property. The city aims to create a
demonstration project on city land for local homeowners to use as a guideline for installing living shorelines
on their property.
The purpose of this Request for Qualifications (“RFQ”) is to evaluate qualifications from firms that are most
suited to performing work for the city. The city is seeking firms who are known for their quality of work and
appropriate experience.
2. SCOPE OF WORK
The selected firm shall:
provide engineered drawings to be used during the SC-DHEC OCRM permitting process,
execute the OCRM permitting process,
coordinate with a marine contractor for material procurement and installation of the living shoreline,
assist with installation of the living shoreline, and
facilitate communication with community members, to include one public education event and one
in-the-field event.
Selected firm must demonstrate relevant expertise and experience in the fields of shoreline management and
resilient coastal practices.
Deliverables (prices for each deliverable should be itemized to the extent possible):
1. Shovel-ready design and permit of a living shoreline along ~100 linear feet of marsh at Folly
River Park.
2. Coordination of installation of the permitted living shoreline.
3. A homeowner’s manual with instructions for residents on how to permit and install a living
shoreline, including a print and online version.
4. Public engagement process to include two public meetings.

3. SELECTION PROCESS
a. There is one additional document, Attachment A.
b. Questions may be emailed to Jenna Stephens at jstephens@follybeach.gov. Answers will be
provided in an addendum to all who have requested the packet prior 03/15/24. Please note there
is no pre-bid meeting for this RFQ.
c. Qualification packages must be submitted by email no later than 5:00 p.m. on 03/25/24. Packages
may be emailed to jstephens@follybeach.gov. Any packages received after this date and time will
not be considered. Submittals must be clearly labeled as RFQ 03-24, LIVING SHORELINE
DEMONSTRATION PROJECT.
d. The qualification packages will be opened at 2:05 p.m. on 03/26/24. All submitters are invited to be
present or send a representative, but attendance is not required.
e. Evaluation of qualifications will be conducted from 03/26/24 through 04/01/24. The selection
decision for the selected firm will be by City Council resolution at a regularly scheduled Council
Meeting on 04/09/24. The winning firm will be notified after the City Council Meeting.
4. BID REQUIREMENTS
The proposal must include the following documents as applicable to be considered responsive. Please mark
each section accordingly within the proposal. Under the provisions of the Freedom of Information Act, all
proposals, excluding pending legal actions, will become public information. Offerors must clearly mark as
“CONFIDENTIAL” each page of their proposal that could be exempt from disclosure. The city reserves the
right to make the final determination.
a. Signed Offeror Representations (form in bid packet) signed by a principal of the firm or an officer
authorized to bind the corporation.
b. Qualifications to meet the city’s objectives. This shall include size of the business, office
location from which service is provided.
c. Pricing, stated in cost per month.
d. Prior work performed, including names and contact information for a minimum of three
professional references.
e. Indicate and list any pending legal actions.
f. Provide current copy of IRS Form W9.
g. Outsourcing Statement: If your organization must outsource or subcontract any work to meet the
requirements contained herein, this must be clearly stated in the proposal. Costs should be
clearly described for any outsourced or subcontracted work.

All contractual terms and conditions will be subject to review by the City of Folly Beach. This request does
not commit the city to the award of a contract, or to pay any costs incurred in the preparation of a response
to this request. The City of Folly Beach reserves the right to reject, in whole or in part, any bid submitted
which, in the judgment of the City of Folly Beach, would not be in its best interest. The city also reserves
the right to waive minor deficiencies or reject any or all proposals.
5.OTHER REQUIREMENTS OF THE SELECTED FIRM
If contract is awarded, the winning firm must be prepared to provide and agree to the following, at his
or her own expense, prior to beginning work and at all times during performance of services:
a. COMMERICAL AND GENERAL LIABILITY INSURANCE on an occurrence
basis in an amount equal to $1,000,000 for each occurrence and must include the
following coverages: (i) completed operations coverage, (ii) blanket contractual
coverage, including both oral andwritten contracts, (iii) personal injury coverage.
b. WORKER’S COMPENSATION INSURANCE to the statutory limits required by
South Carolina state law.
c. LEGAL COMPLIANCE. Compliance with all applicable federal, state and local laws,
ordinances and regulations.
d. TITLE VI OF THE CIVIL RIGHTS ACT OF 1964. Consultants shall comply with Title VI
of the Civil Rights Act of 1964. The city strongly encourages the use of and involvement of
Disadvantaged Business Enterprises (DBE) on this project.
e. DISADVANTAGED BUSINESS ENTERPRISES. It is the policy of the City that
Disadvantaged Business Enterprises (DBEs) and other small businesses shall have the
opportunity to compete fairly in contracts financed in whole or in part with public funds.
Consistent with this policy, the city will not allow any person or business to be excluded
from participation in, denied the benefits of, or otherwise is discriminated against in
connection with the award and performance of any contract because of sex, race, religion,
or national origin.
f. CONFLICT OF INTEREST. The successful firm shall not knowingly employ, during the
period of a contract, or any extensions to it, any professional personnel who are also in the
employ of the city and who are providing services involving this request or services similar
in nature to the scope of this request to the city. Furthermore, the firm shall not knowingly
employ, during the period of a contract or any extensions to it, any city of the city employee
who has participated in the making of a contract until at least two years after his/her
termination of employment with the city.
g. PROHIBITION OF GRATUITIES. Neither the firm, nor any person, firm or corporation

employed by the firm in the performance of this request, shall offer or give any gift, money
or anything of value or any promise for future reward or compensation to any city employee
at any time.
h. INDEMNIFICATION AND HOLD HARMLESS. The successful firm shall agree to
protect, defend, indemnify, and forever hold harmless, the city, its agents, officers, and
employees, from and against any and all claims, liabilities, damages, costs, actions,
proceedings, of any nature whatsoever, however alleged or termed, or in any lawsuits,
arising in any manner out of any action or failure to act, by the firm, its officers, agents, and
employees, or relating to or arising out of the performance or failure to perform, by the
firm, its officers, agents, and employees, any obligations arising under its agreement with
the city, or any other type claim/lawsuit whatsoever, however alleged or termed, which may
arise at any time as a result of or related to the provision of service(s) for the city by the
successful firm, without regard to the source, nature, or validity of the claim/lawsuit.
Losses, liabilities, expenses and claims for damages shall include, but not be limited to, civil
and criminal fines and penalties, loss of use and/or services, claims for injury, damage,
disability, property damage, or death, injury to real or personal property, and attorneys’
fees, costs, and expenses incurred by the city or any of its agents, officers, and employees.
i. INSURANCE BENEFITS. The city shall not be precluded from receiving the benefits of
any insurance the firm may carry which provides for indemnification for any loss or damage
to property in the firm’s custody and control, where such loss or destruction is to city
property. The firm shall do nothing to prejudice the city’s right to recover against third
parties for any loss, destruction, or damage to city property.
j. DRUG-FREE WORKPLACE. During the performance of this request, the firm agrees to
provide a drug-free workplace for its employees; post in conspicuous places, available to
employees and applicants for employment, a statement notifying employees that the
unlawful manufacture, sale, distribution, dispensation, possession, or use of a controlled
substance or marijuana is prohibited in the workplace and specify the actions that will be
taken against employees for violations of such prohibition; and state in all solicitations or
advertisements for employees placed by or on behalf of the firm that the firm maintains a
drug-free workplace. For the purposes of this section, “drug-free workplace” means a site
for the performance of work done in connection with a specific contract awarded to a
contractor/firm in accordance with this chapter, the employees of whom are prohibited from
engaging in the unlawful manufacture, sale, distribution, dispensation, possession or use of
any controlled substance or marijuana during the performance of the request.
k. S.C. LAW CLAUSE. Upon award of a contract under this request the person, partnership,
association, or corporation to whom the award is made must comply with the laws of South
Carolina which require such person or entity to be authorized and/or licensed to do business
with this State. Notwithstanding the fact that applicable statutes may exempt or exclude the
successful firm from requirements that it be authorized and/or licensed to do business in this
State, by submission of this signed proposal, the firm agrees to subject himself to the
jurisdiction and process of the courts of the State of South Carolina as to all matters and
disputes arising or to arise under the contract and the performance thereof, including any
questions as to the liability for taxes, licenses, or fees levied by the State.

l. CITY BUSINESS LICENSE. If work is performed within the jurisdiction of the city,
maintenance of local licenses necessary to operate a business in the City of Folly Beach will
be required. These costs are not to be paid in whole or in part by the city.
m. SC SALES TAX. The city is not tax exempt; therefore, all applicable taxes must be paid on
all applicable purchases.
n. CONTRACT. The bidder selected will engage in a contractual agreement based on this
proposal prior to any work being performed.
o. CONTRACT MODIFICATIONS. Any modifications to the contract shall be in writing and
signed by both parties.
5. QUALIFICATIONS EVALUATION CRITERIA
The primary intent with regard to the procurement of these services is to obtain what the city would
consider to be the best package of product and service. This includes overall suitability, a clear and
organized proposal, price competitiveness, quality, and timeliness of previous work performed. Firms will
further be evaluated on their experience, qualifications, and references.
