Failure to acknowledge receipt of any addenda that may be issued may result in the
rejection of the bid.

All bids must be submitted on the Bid Proposal Form and must conform to the specifications, terms and
conditions for a fair and open contract, all of which are contained therein.
Bidders must review the bid specifications for any applicable bonding requirements. Where required, bids
must be accompanied by a certified check, bid bond or cashier’s check payable to the Township of Randolph
in the amount specified in the bid documents. Bids for contracts that require a Performance Bond must also
contain a Consent of Surety.
Bidders must have any and all required approvals, qualifications, certifications, and/or licenses necessary to
perform the services or provide the products as contained in the bid specifications.
Bidders are required to comply with the requirements of N.J.S.A. 10:5-31 et seq. and N.J.A.C. 17:27. Other
requirements as well as these described above are fully detailed in the bid documents.

BID SPECIFICATIONS
CONTRACT #43: PROPANE GAS
Contract Period – One Year: July 1, 2024 - June 30, 2025
Contract Period – Two Years: July 1, 2024 - June 30, 2026
Contract Period - Three Years: July 1, 2024 – June 30, 2027
Due to the nature of the products contained within this contract, estimated quantities are not provided.
THIS IS NOT A REQUIREMENTS CONTRACT.
Prices are to remain firm for the term of the contract with no exceptions. No minimum order
requirements are allowed. All prices are FOB Destination, Freight Prepaid.
THE FOLLOWING ARE MINIMUM SPECIFICATIONS WHICH MUST BE MET OR EXCEEDED.
GENERAL SPECIFICATIONS
1. This proposal for propane gas covers requirements for the members of the Morris County Cooperative
Pricing Council (MCCPC).
2. The propane gas supplied shall be in accordance with Type II, Propane, Federal Specification BB-G-110A-
1, effective May 4, 1971, Amendment #1 dated January 17, 1973, Amendment #2 dated February 27,
1981, and Notice #1 dated October 1, 1981, and any additional supplements thereafter.
3. The gas, tanks, cylinders, bottles, valves, piping, etc., shall conform to the latest NFPA pamphlet of the
National Fire Protection Association.
4. Where required, tanks, bottles or cylinders shall be supplied and installed by the successful bidder. The
installation is to include all the required piping, valves, gauges, fittings and any other pertinent equipment to
service the member MCCPC agencies for no additional charge.
A deposit from the using agency will not be required for these cylinders, bottles and/or tanks.
5. Temporary Voluntary Allowances (TVAs) will not be included in the bid prices as they cannot be considered
in evaluating bids. However, if the bidder extends voluntary allowances during the term of the contract to
federal, state and local governments or to commercial users in the normal course of doing business, the
MCCPC membership requires the TVAs will also be available to them in the maximum amount extended to
others who contract to purchase propane gas under similar contractual terms and conditions.
6. The total bid price is to include the cost of installing, equipping and filling the specified tank(s) or
cylinder(s), for each specified location, except in those cases where the location owns its own tank(s) or
cylinder(s). These are designated by an asterisk (*) within the proposal, and the bidder is to bid the total
price for filling the tanks or cylinders in these cases.
7. It is understood by all bidders that there will be no minimum amount required or established by any bidder
as a condition for consideration in the procurement of propane gas under this contract. Bidders must bid
on all three (3) categories.
8. During the course of this contract, responding MCCPC members may ADD or DELETE locations. The
added locations will adopt the price and contract vendor servicing that location in the same community of a

similar tank capacity. Bidders must be aware of this requirement and do agree to it by virtue of their
signature on the bid proposal.
9. Pricing will be based upon information available through the U.S. Energy Information Administration (EIA).
Should the EIA become a subscription-based service at any point during the term of this contract, the
successful vendor will be required to pay for and provide the “MCCPC and its members” with a subscription
(one subscription for all, not each) to the service for no additional charge for the remaining term of the
contract.
Should the U.S. Energy Information Administration (EIA) no longer publish the “Today in Energy – Daily
Prices – U.S. Energy Information Administration (EIA)”, the MCCPC must agree to whatever new
publication is chosen.
PRICING
1. INDEX PRICE FOR PROPANE
For the purpose of this bid, the bidder is to indicate his upcharge/downcharge (bid price quoted) on the bid
proposal form which is to be added to the “Propane, Mont Belvieu, Texas,” as posted online in the “Today in
Energy – Daily Prices – U.S. Energy Information Administration (EIA)”. The price quoted by bidders in their bid
proposal will be assumed to be an upcharge unless it is clearly defined as a downcharge.
After award of bid, prices will be compiled weekly on Monday. These will be referred to as the “Index Price”.
The “Index Price” is the price listed for “Propane, Mont Belvieu, Texas,” as posted online in the “Today in
Energy – Daily Prices – U.S. Energy Information Administration (EIA)” for the previous Thursday. This posted
price is to be used for all deliveries for that Monday through the following Sunday. (If the U.S. Energy
Information Administration (EIA) does not publish a Thursday price, the MCCPC will use the published price for
the day before or the most recently published prior day.)
• For example, the price for a delivery of propane made between Monday, January 15, 2024, through Sunday,
January 21, 2024, is the price from the previous Thursday (January 11, 2024) plus the upcharge/downcharge.
HOW TO DETERMINE THE PRICE PER DELIVERED GALLON OF PROPANE
The price the MCCPC members will pay per delivered gallon of fuel will be determined by adding/subtracting
the constant upcharge/downcharge bid to/from the index price of the fuel based on the MCCPC’s compiled list.
EXAMPLE: The awarded vendor is XYZ Propane Gas Company. The upcharge that XYZ Propane Gas
Company bid was $0.1000/gal. An MCCPC member received a delivery of propane on Wednesday, January
17, 2024.
The “Propane, Mont Belvieu, Texas” price as posted online in the “Today in Energy – Daily Prices – U.S.
Energy Information Administration (EIA)” for Thursday, January 11, 2024, is $0.78 /gal. This price is compiled
by the MCCPC.
The Price per Gallon of delivered fuel on January 17, 2024, is determined as follows:

2. Requests for an increase to compensate for other increases in the cost of doing business will not be
granted or considered. All bidders are reminded that all MCCPC members are tax free entities and they will
not be required to pay any gross receipts taxes or super-fund taxes during the entire period of the contract,
nor any hazmat fees or fuel surcharge fees.
