OUTPATIENT TREATMENT FOR FELONY DUI COURT PROGRAM
1.
TERMS
The term "EJDC,” as used throughout this document will mean the Eighth Judicial District Court. The term "EC" as used
throughout this document will mean the Executive Committee which is the Governing Body of Eighth Judicial District Court.
The term "CEO" as used throughout this document will mean the EJDC Court Executive Officer or his designee responsible
for the Purchasing and Contracts Division. The term "PROPOSER" as used throughout this document will mean the
respondents to this Request for Proposal. The term “PROVIDER(S)” as used throughout this document will mean the
awarded proposer(s) as it pertains to the Scope of Work in this Request for Proposal. The term "RFP" as used throughout
this document will mean Request for Proposal. The term “NGEM” as used throughout this document will mean the Nevada
Government e-Marketplace. The Nevada Government e-Marketplace System is an electronic bidding system that is used
by EJDC for the submission of electronic proposals. There is no cost for any PROPOSER to use the NGEM system. All
PROPOSERS that choose to respond to a proposal must do so electronically, through the NGEM system and must register
prior to gaining access to see the details of any solicitation or to submit a proposal online.
2.
INTENT
The intention of this RFP is to find qualified respondents to provide outpatient treatment to participants of the Felony DUI
Court Program. EJDC’S intention is to award one or more PROPOSERS in order to service the total population of Felony
DUI Court Program participants, which is up to 350 participants. Each PROPOSER is required to identify the maximum
number of participants it can serve. If more than one PROPOSER is awarded, the awardees will be required to collectively
serve all participants at any time.
SCOPE OF WORK
A.
Background
The EJDC Felony DUI Court is a Specialty Court program, which provides a positive alternative to incarceration and breaking
the cycle of alcohol and drug use and criminal recidivism through rehabilitation. An essential component of this program is
engaging specialized service providers, which are capable of working with this population, to help them address both the
physiological and psychological root of their substance abuse and work towards sustaining and alcohol and drug-free lives.
B.
Responsibilities of Provider – Counseling Services
1.
PROVIDER shall provide substance abuse and mental health treatment for adults who are ordered into
the Felony DUI Court by EJDC Judges. The treatment services shall be tailored to meet the individual
needs of each client and all program participants shall be provided individual and group counseling
sessions. PROVIDER shall facilitate group treatment to only Felony DUI participants, these groups should
not be comingled with other programs, community referrals, or other EJDC programs.

The services may include but are not limited to the following:
a)
Intake and Assessment
b)
Treatment Planning
c)
Individual and Family Counseling
d)
Psychiatric Services
e)
Group Counseling: Provider shall offer a large variety of clinical groups facilitated utilizing
evidence-based curriculum, such as, but not limited to psychoeducational groups, anger
management/ impulse control groups, co-occurring disorders, mental health groups, trauma
groups, gender specific groups. Provider must provide criminal thinking groups; MRT (moral
recognition therapy) as part of the program.
f)
Educational/Vocational Assessment and Assistance
g)
Support Meetings
h)
Client Progress Reports- for use by the FDUI team including level up reports, ASAM’s, and other
clinical evaluations to support level of care.
i)
Discharge/Aftercare Planning
j)
Aftercare Services: referrals for positive peer/ alumni groups, FDUI mentoring program and other
aftercare services as needed.

k)
Case Management Services; assistance enrolling in insurance, coordinating transportation,
medical needs, financial planning, employment services, other basic needs.
3.
PROVIDER shall perform all work in accordance with evidence based treatment modalities and
methodologies as approved by the EJDC Coordinator, as well as, the 10 Key Components of Drug
Court recommended by the National Drug Court Institute and subject to compliance with this Contract.
EJDC Coordinator will approve all curriculums and any training paid for by the EJDC and attended by
the PROVIDER will be incorporated and implemented within 90 days of attendance. If the Provider is
unable to implement the training, PROVIDER must communicate why they are unable to implement and
have a comparable training to recommend to EJDC and EJDC Coordinator.
4.
Evidence Based Practices
EJDC requires contractors to use evidence-based treatment approaches. Evidence based practices
includes treatment strategies and interventions for which observable, objective data exist demonstrating
positive effects. Using evidence-based treatment means using interventions that have been shown to
work. EJDC contracted providers are expected to utilize data about an individual’s progress along with
the best available information about “what works” in planning and revising treatment. The data (or
evidence-bases) showing the positive effects of mental health and/or substance abuse treatment
practices can take one of four major forms, listed below in order of their relative strength. Information
about the evidence base for various practices should be utilized throughout the course of treatment to
make clinical decisions. Higher priority should be given to more reliable or stronger forms of evidence in
making treatment decisions. Clinically-driven and outcomes-driven treatment is individualized, person-
centered and responsive to specific participant’s needs and progress toward recovery. This is a departure
from focusing on “placement” in a program, often with a fixed length of stay, and a move toward more
individually determined care. Furthermore, it is a move toward the client’s response to treatment, lengths
of stay that are individualized and based on the severity of a client’s illness, level of functioning at
treatment entry, and response to treatment, progress and outcomes.
5.
Standards for Substance Abuse and Mental Health Counseling
a. Qualifications: PROVIDER will ensure that its employees shall have the skills, training, and
expertise to conduct client intakes and assessments; provide case management services that
include, but are not limited to preparing written treatment plans and monitoring and documenting
client progress in relation to treatment plans; work with clients to develop goals and objectives and
making adjustments to the level of care as needed; provide both individual and group counseling
services; and, develop and carry out program discharge and aftercare plans.
b. SAPTA Certifications: PROVIDER shall be certified by Nevada’s Substance Abuse Prevention and
Treatment Agency (SAPTA).
c. Substance Abuse Counselors: PROVIDER will ensure that all substance abuse counselors shall
have active licenses based upon their respective board’s current requirements and, at a minimum,
be CADC certified or in a CADC Internship under a Licensed (LADC) Supervisor by the State of
Nevada Board of Examiners of Alcohol, Drugs and Gambling. If the counselor is an intern, a Board
Supervisor must also be onsite and/or employed by PROVIDER or the organization must comply
with state Board regulations regarding supervision appropriately.
d. Mental Health Counselors: PROVIDER will ensure that all mental health counselors shall have
active licenses based upon their respective board’s current requirements and, at a minimum one of
the following; be LCADC certified, licensed as a CPC, licensed as a MFT, licensed as a LCSW or in
a LCADC Internship, CPC Internship, MFT Internship, or LCSW Internship under a Licensed
Supervisor. Licensed (LCADC) Supervisor is issued by the State of Nevada Board of Examiners of
Alcohol, Drugs and Gambling. A Licensed MFT/ CPC Supervisor is approved by the Nevada Board
of Examiners for Marriage and Family Therapists and Clinical Professional Counselors. A Licensed
Clinical Social Work Supervisor is approved by the Nevada Board of Examiners for Social Workers.
If the counselor is an intern, a Board Supervisor must also be onsite and/or employed by PROVIDER
or the organization must comply with state Board regulations regarding supervision appropriately.
6.
Staff Participation - PROVIDER shall provide staff approved by the EJDC to attend Specialty Court
hearings and pre-court meetings as required by EJDC. Provider therapists need to be available to staff
cases, provide treatment recommendations, and attend court staffing as needed. Preferably, the assigned
staff should carry a caseload of FDUI participants or is facilitating groups for FDUI participants.

C.
Treatment Requirements
1.
Group Populations: PROVIDER shall facilitate group treatment to only Felony DUI participants, these
groups should not be comingled with other programs, community referrals, or other EJDC programs,
unless PROVIDER seeks prior approval from the EJDC Coordinator and the request is staffed and
approved by the EJDC.
2.
Ratios: PROVIDER shall maintain a 15:1 participants to counselor ratio for therapeutic groups. Provider
shall have a designated FDUI counseling team.
3.
Sessions: All individual sessions will be a minimum of sixty (60) minutes in length; all group counseling
sessions will be a minimum of ninety (90) minutes per session unless otherwise specified by the evidence-
based curriculum. PROVIDER shall schedule no more than one (1) session on any given day for a
participant unless authorized by EJDC Coordinator.
4.
Treatment: EJDC and PROVIDER hereby agree that the following requirements are the minimum
required under the terms of this contract. Changes to these requirements may be altered in writing by
mutual agreement of EJDC and PROVIDER.
a. Level One: One 60-minute individual counseling session and two 90-minute group counseling
sessions per week for a period of 9 months. Session requirements and price can be altered if
determined appropriate by EJDC and PROVIDER.
b. Level Two: One 60-minute individual counseling session per week and one 90-minute group
counseling session per week for a period of no less than nine (9) months. Session requirements
and price can be altered if determined appropriate by EJDC and PROVIDER. During Level Two,
MRT (Moral Recognition Therapy) would be a required group clients must attend, unless
otherwise approved by EJDC. After the course has been completed the participant would be
lowered into a substance misuse/co-occurring group.
c. Level Three: Alternating between one 90-minute group counseling session per week and one
60-minute individual counseling session per week for a period of no less than (9) months.
Session requirements and price can be altered if determined appropriate by EJDC and
PROVIDER.
d. Level Four: EJDC Coordinator alone determines transition to this level. This level is reserved
for the participants who have done extremely well in their level of compliance. This level is one
90-minute group or one 60-minute individual session every other week for a maximum of 9
months.
5.
Service Period: PROVIDER is required to provide services a minimum of six (6) days per week. Hours
of operation will be scheduled to provide reasonable access to services for program clients; reasonable
access of services will be defined, as the hours of operation will accommodate a minimum of 90% of the
participants. Scheduled treatment services may be provided within the five weekdays, but one weekend
day will be made available for any missed groups, individual sessions, or mandatory activities.
6.
Client Records: PROVIDER shall maintain detailed individual client records documenting intake
assessments, notes, behavioral contracts, the treatment goals and progress each program participant
makes towards successfully completing his/her treatment plan. The PROVIDER will maintain the records
for seven (7) years after the client exits services.
D.
Administrative Requirements
1.
DCCM: PROVIDER shall enter and maintain the DCCM data for all participants, including but not limited
to all drug testing results, missed/no show drug testing, participation in counseling sessions, missed/no
show counseling sessions, and any other treatment information relevant to the participants’ compliance
or non-compliance with the specialty courts program requirements. All required information must be
entered into DCCM within 24 hours of services provided to participant. PROVIDER shall not share
information documented in DCCM aside from urine analysis (UA) results with the client unless approved
by the EJDC Coordinator.
a. PROVIDER must notify EJDC when a DCCM user from their agency no longer requires access
to DCCM, therefore allowing EJDC to close out the account.
b. PROVIDER will enter and maintain data related to behavioral issues or concerns,
hospitalizations, and any other updates pertaining to the participant.
