INVITATION TO BID - PROJECTOR UPGRADES
GENERAL PROVISIONS
In accordance with the terms and conditions provided in this solicitation document, it is
the intent of this formal Invitation to Bid (ITB) to receive responses from qualified Bidders to
furnish projectors, lens, equipment and materials as specified.
Please read carefully all instructions, general terms and conditions, purchase order terms and
conditions, scope of work and/or specifications, Response Forms, insurance requirements, if
applicable, and Minimum Contract Terms, if applicable. Failure to comply with the
instructions, terms and conditions, scope of work and/or specifications, of the ITB may result in
your Proposal being declared non-responsive.
1.
DEFINITIONS
A.
Addendum: A written document issued by Owner, prior to the submission
deadline, which modifies or clarifies the solicitation documents by additions,
deletions, clarifications, or corrections.
B.
Contract: Contract documents include the purchase order, solicitation
documents, Bidder’s response form/required attachments, all addenda,
required submittals, Provider’s performance bond and valid certificates of
insurance, if applicable.
C.
F.O.B. Destination: Designates the seller will pay shipping costs and remain
responsible for the goods until the buyer takes possession.
D.
Governing Body: The Las Vegas-Clark County Library District’s Board of
Trustees.
E.
Lot: A group of items similar in nature

“NGEM System” refers to Owner’s electronic bidding system, the Nevada
Governmental eMarketplace. This is a web-based system that provides Bid
Documents electronically to potential Bidder and forms the pathway for
interested Bidder to submit Proposals electronically in response to
advertisement and ITB. The term “electronic proposal” means the Bidder’s
electronic response submitted on the electronic proposal to the Owner by way of
the NGEM System. The term “electronic proposal” also describes the
process to submit an authorized proposal electronically to Owner in response to
an ITB via the NGEM System.
G.
Nevada Revised Statutes (NRS): The current codified laws of the State of
Nevada. Nevada law consists of the Constitution of Nevada (the state
constitution) and Nevada Revised Statutes. The Nevada Supreme Court
interprets the law and constitution of Nevada.
H.
No Substitute: Means there is only one brand name product acceptable to
perform the function required.
I.
Bidder: Any party submitting a response to this solicitation.
J.
Owner: The Las Vegas-Clark County Library District.

K.
Bidder who is the lowest responsive, responsible or best Bidder to whom the Owner
awards the contract.
L.
Response: All required information submitted by Bidder.
M. Purchase Order: The formal authorization by Owner for Provider to provide goods or
services to Owner. The formal contract takes precedence over any conflicting terms
and conditions contained in the purchase order.
N. Solicitation: The Invitation to Bid.
O. Solicitation Documents: May include, but are not limited to - Invitation to Bid, General
Provisions, General Conditions, Special Conditions, Product Specifications, Exhibits,
Special Provisions, Drawings, and any Addenda issued prior to the date designated for
receipt of Responses, as applicable.
P.
Subcontractor/Independent Contractor: Any individual, agent, firm, sole proprietor, or
corporation to whom the Bidder subcontracts any part of the project. There is no
contractual relationship between the Owner and the above-mentioned Subcontractor/
Independent Contractor who perform work or services for the Bidder.
Q. Trustee: A member of the Library District’s Board of Trustees
2. REGISTRATION FOR NGEM SYSTEM
A. The NGEM System is accessible at www.ngemnv.com. Bid documents can be viewed
by selecting a specific project from the Current Bid Opportunities list and clicking on
that project after completing the Supplier Registration.
B. Potential Bidders MUST register as a “Supplier” by clicking on the Supplier Registration
link and completing the registration form. There is no cost to register or to use the
NGEM System.
C. Once registered, “Suppliers” will receive emails notifying of bid
opportunities. Downloading any project bid data will automatically place the
bidder’s contact information on the bidders list and the NGEM System will
automatically send any and all updates, changes or addenda associated with that
project.
D. An electronic bid proposal can only be submitted through the NGEM System. The Bid
Documents can be printed for Bidder’s use, but an electronic bid MUST be submitted
through the NGEM System.
E. Questions regarding use of the NGEM System may be directed by email to:
PURCHASING@THELIBRARYDISTRICT.ORG or by calling (702) 507- 6200.
3. COPIES OF BID DOCUMENTS
A. Complete sets of “electronic” Bid Documents are available for download to registered
Bidders at No Cost from the NGEM System.
B. Via email at PURCHASING@THELIBRARYDISTRICT.ORG. Provide ITB number,
company name, address, contact person, email address, and phone number.
C. Bidder is solely responsible for obtaining a full set of available project/bid documents.
D. Bid proposals must contain a complete set of bidding documents, which consists of all
documents requiring a response. Owner will reject manual bid proposals not containing
a complete set of bid documents or su5bmitted on the incorrect forms. Owner assumes
