OUTPATIENT TREATMENT FOR THE TAP AND OPEN PROGRAMS
1.
TERMS
The term "EJDC,” as used throughout this document will mean the Eighth Judicial District Court. The term "EC" as used
throughout this document will mean the Executive Committee which is the Governing Body of Eighth Judicial District Court.
The term "CEO" as used throughout this document will mean the EJDC Court Executive Officer or his designee responsible
for the Purchasing and Contracts Division. The term "PROPOSER" as used throughout this document will mean the
respondents to this Request for Proposal. The term “PROVIDER(S)” as used throughout this document will mean the
awarded proposer(s) as it pertains to the Scope of Work in this Request for Proposal. The term "RFP" as used throughout
this document will mean Request for Proposal. The term “NGEM” as used throughout this document will mean the Nevada
Government e-Marketplace. The Nevada Government e-Marketplace System is an electronic bidding system that is used
by EJDC for the submission of electronic proposals. There is no cost for any PROPOSER to use the NGEM system. All
PROPOSERS that choose to respond to a proposal must do so electronically, through the NGEM system and must register
prior to gaining access to see the details of any solicitation or to submit a proposal online.
2.
INTENT
EJDC is soliciting proposals for the Outpatient Treatment for the Adult Drug Court’s Transitional Age Program (TAP) and
the Opportunity for Probation with Enforcement in Nevada Program (OPEN). EJDC’S intention is to award one PROVIDER
in order to service the total population of Adult Drug Court Program participants, which is up to 150 participants. Each
PROPOSER is required to identify the maximum number of participants it can serve.
SCOPE OF WORK
A.
Background
The Adult Drug Court Transitional Age Program (TAP) of the EJDC targets offenders who have serious addictions to drugs
and/or alcohol. The purpose of this program is to provide professional substance misuse and mental health services to
these offenders as a positive alternative to incarceration. The goal is to afford these offenders the opportunity to break their
cycle of substance use and criminality recidivism through rehabilitation. An essential component of this program is engaging
specialized service providers that are capable of working with this population, to help them address both the physiological
and psychological root of their substance misuse and work towards sustaining drug-free lives. The Opportunity for Probation
with Enforcement in Nevada program (The OPEN program) provides intensive behavioral modification programing to
participants in the hope to decrease their criminal behaviors through evidence based treatment addressing participant’s
individual needs. The OPEN Program attempts to reintegrate participants into the community, assessing their individual
needs and connecting them with the appropriate community based treatment, academic and vocational resources, while
working to address their court requirements simultaneously. The program offers substance misuse treatment, random
drug/alcohol testing, and court supervision of program compliance.

B.
Responsibilities of Provider – Counseling Services
1.
PROVIDER shall provide substance abuse and mental health treatment for adults ordered into the TAP
program or the OPEN program by EJDC Judges or Hearing Masters. The treatment services shall be
tailored to meet the individual needs of each client and all program participants shall be provided individual
and group counseling sessions and additional services. PROVIDER shall facilitate group treatment to
only TAP and OPEN participants, these groups should not be comingled with other programs, community
referrals, or other EJDC programs.
2.
The services may include but are not limited to the following:
a.
Intake and Assessment
b.
Treatment Planning
c.
Individual and Group Counseling
d.
Co-Occurring Treatment
e.
Couples, Family, and Children’s Therapy
f.
Psychiatric Services with Medication Management
g.
Group Counseling: Provider shall offer a large variety of clinical groups facilitated utilizing
evidence-based curriculum, such as, but not limited to psychoeducational groups, relapse

prevention groups, anger management/ impulse control groups, co-occurring disorders, mental
health groups, trauma groups, gender specific groups. Provider must provide criminal thinking
groups; MRT (moral recognition therapy) as part of the program.
h.
Educational/Vocational Assessment and Assistance
i.
Parent Education and Support Meetings
j.
Client Progress Reports- for use by the TAP and OPEN teams including level up reports,
ASAM’s, and other clinical evaluations to support level of care.
k.
Discharge/Aftercare Planning
l.
Aftercare Services: referrals for positive peer/ alumni groups, mentoring programs, and other
aftercare services as needed.
m.
Case Management Services; assistance enrolling in insurance, coordinating transportation,
medical needs, financial planning, employment services, other basic needs.
3.
PROVIDER shall perform all work in accordance with evidence based treatment modalities and
methodologies as approved by the EJDC Coordinator, as well as, the 10 Key Components of Drug
Court recommended by the National Drug Court Institute and subject to compliance with this Contract.
EJDC Coordinator will approve all curriculums and any training paid for by the EJDC and attended by
the PROVIDER will be incorporated and implemented within 90 days of attendance. If the Provider is
unable to implement the training, PROVIDER must communicate why they are unable to implement and
have a comparable training to recommend to EJDC and EJDC Coordinator.
4.
Evidence Based Practices
EJDC requires contractors to use evidence-based treatment approaches. Evidence based practices
includes treatment strategies and interventions for which observable, objective data exist demonstrating
positive effects. Using evidence-based treatment means using interventions that have been shown to
work. EJDC contracted providers are expected to utilize data about an individual’s progress along with
the best available information about “what works” in planning and revising treatment. The data (or
evidence-bases) showing the positive effects of mental health and/or substance abuse treatment
practices can take one of four major forms, listed below in order of their relative strength. Information
about the evidence base for various practices should be utilized throughout the course of treatment to
make clinical decisions. Higher priority should be given to more reliable or stronger forms of evidence in
making treatment decisions. Clinically-driven and outcomes-driven treatment is individualized, person-
centered and responsive to specific participant’s needs and progress toward recovery. This is a departure
from focusing on “placement” in a program, often with a fixed length of stay, and a move toward more
individually determined care. Furthermore, it is a move toward the client’s response to treatment, lengths
of stay that are individualized and based on the severity of a client’s illness, level of functioning at
treatment entry, and response to treatment, progress and outcomes. PROVIDER shall identify new
evidence based best practices and curriculums throughout the life of the contract.
5.
Standards for Substance Abuse and Mental Health Counseling
a. Qualifications: PROVIDER will ensure that its employees shall have the skills, training, and
expertise to conduct client intakes and assessments; provide case management services that
include, but are not limited to preparing written treatment plans and monitoring and documenting
client progress in relation to treatment plans; work with clients to develop goals and objectives and
making adjustments to the level of care as needed; provide both individual and group counseling
services; and, develop and carry out program discharge and aftercare plans.
b. SAPTA Certifications: PROVIDER shall be certified by Nevada’s Substance Abuse Prevention and
Treatment Agency (SAPTA).
c. Substance Abuse Counselors: PROVIDER affirms that all substance abuse counselors shall have
active licenses based upon their respective board’s current requirements and, at a minimum, be
CADC certified or in a CADC Internship under a Licensed (LADC) Supervisor by the State of Nevada
Board of Examiners of Alcohol, Drugs and Gambling. If the counselor is an intern, a Board Supervisor
must also be onsite and/or employed by PROVIDER or the organization must comply with state
Board regulations regarding supervision appropriately.
d. Mental Health Counselors: PROVIDER affirms that all mental health counselors shall have active
licenses based upon their respective board’s current requirements and, at a minimum one of the
following; be LCADC certified, licensed as a CPC, licensed as a MFT, licensed as a LCSW or in a
LCADC Internship, CPC Internship, MFT Internship, or LCSW Internship under a Licensed
Supervisor. Licensed (LCADC) Supervisor is issued by the State of Nevada Board of Examiners of
Alcohol, Drugs and Gambling. A Licensed MFT/ CPC Supervisor is approved by the Nevada Board
of Examiners for Marriage and Family Therapists and Clinical Professional Counselors. A Licensed

Clinical Social Work Supervisor is approved by the Nevada Board of Examiners for Social Workers.
If the counselor is an intern, a Board Supervisor must also be onsite and/or employed by PROVIDER
or the organization must comply with state Board regulations regarding supervision appropriately.
6.
Staff Participation
a. PROVIDER shall provide staff approved by the EJDC to attend Specialty Court hearings and pre-
court meetings as required by EJDC. Provider therapists need to be available to staff cases, provide
treatment recommendations, and attend court staffings as needed. The assigned staff will carry a
caseload of TAP and OPEN participants or is facilitating groups for TAP and OPEN participants.
C.
Treatment Requirements
1.
Intake Assessments: PROVIDER is required to be able to accept referrals, schedule intake assessment,
and complete the intake assessment with the level of care recommendation and group schedule within
72 hours of the referral received. If the PROVIDER is unable to meet the 72 hour, timeframe will notify
the EJDC Coordinator why the delay and a solution to correct the delay or allow the EJDC Coordinator to
plan for alternate options to start the referred participant in treatment.
2.
Ratios: PROVIDER shall maintain a 15:1 participants to counselor ratio for substance use therapeutic
groups. PROVIDER shall maintain an 8:1 participant to counselor ratio for mental health therapeutic
groups. Provider shall have a designated TAP and OPEN program counseling team.
3.
Assignment: Provider shall assign a specific therapist(s) to work with the participants in both the TAP
and OPEN programs. The PROVIDER will staff the therapist with the EJDC Coordinator to ensure the
assigned therapist(s) is clinically appropriate to work with the TAP and OPEN programs.
4.
Sessions: All individual sessions will be a minimum of sixty (60) minutes in length; all group-counseling
sessions will be a minimum of sixty (60) minutes per session unless otherwise specified by the evidence-
based curriculum. PROVIDER shall schedule no more than one (1) session on any given day for a
participant unless authorized by EJDC Coordinator.
5.
Treatment: EJDC and PROVIDER hereby agree that the following requirements are the minimum
required under the terms of this contract. Changes to these requirements may be altered in writing by
mutual agreement of EJDC and PROVIDER.
a. Phase One (18 weeks): One intake session, one individual counseling session per week in
addition to, two group counseling sessions per week;
b. Phase Two (20 weeks): Bi-weekly individual counseling session in addition to, two group
counseling sessions per week;
c. Phase Three (16 weeks): One individual counseling session per month in addition to, two group
counseling sessions per week; and
d. Phase Four (24 weeks): One individual counseling session per month in addition to, one group
counseling session per week, and one discharge session.
e. PROVIDER is required to provide intensive outpatient services, a minimum of nine (9) hour
requirement per week and a minimum of six (6) individual sessions, over a twelve (12) week
period.
f. PROVIDER is required to provide a relapse track, a minimum of one (1) hour requirement for
two (2) weeks and a minimum of one (1) individual session each week, over a two (2) week
period.
g. PROVIDER is required to start participants in treatment groups within a week of the referral
received. If the PROVIDER is unable to meet the one (1) week, timeframe the EJDC must be
notified within 24 hours if unable to start participant in treatment stating why and an update on
the solution to address the delay and provide the necessary treatment.
h. PROVIDER is required to obtain approval from the EJDC Coordinator for any changes in level
of care or deviation from the original treatment plan.
6.
Service Period: PROVIDER is required to provide services a minimum of six (6) days per week. Hours
of operation will be scheduled to provide reasonable access to services for program clients; reasonable
