Army Contracting Command – Detroit Arsenal (ACC-DTA) proposes to award a Firm-Fixed Price (FFP) contract with WFEL Limited (WFEL), the Original Equipment Manufacturer (OEM) of the 46 Meter (m) Dry Support Bridge (DSB), for the inspection, repair as well as repair parts for a quantity of four DSB systems located in Belgium, as well as miscellaneous repair parts for DSB systems located CONUS. Optional coverage for assessments, repairs and repair parts is included for up to two DSB systems located CONUS, as well as an option for training support in order to field the systems. The Government intends to solicit and negotiate with only one source under the authority of Federal Acquisition Regulation (FAR) 6.302-1(a)(2), “Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements.” Specifically, FAR 6.302-1(a)(2)(ii) states “Supplies may be deemed to be available only from the original source in the case of a follow-on contract for the continued development of production of a major system or highly specialized requirement, including major components thereof, when it’s likely that award to any other source would result in – (A) Substantial duplication of cost to the Government that is not expected to be recovered through competition.” FAR 6.302-1(a)(2)(iii) states “Services may be deemed to be available only from the original source in the case of follow-on contracts for the continued provision of highly specialized services when it is likely that award to any other source would result in - (A) Substantial duplication of cost to the Government that is not expected to be recovered through competition.” This is a notice of intent, not a request for competitive action, upon response to this notice, is solely within the discretion of the Government.
